11. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law principles. You irrevocably agree that the courts of Thailand shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms of Use or your use of the Website.

12. Dispute Resolution

Either party may initiate this process by sending written notice to the other party describing the nature of the dispute.

If the dispute cannot be resolved through negotiation within thirty (30) days of the written notice, the parties may seek mediation through the Thai Arbitration Institute (TAI) or a mutually agreed mediator before commencing formal legal proceedings.

Should mediation fail or be declined, the dispute shall be submitted to binding arbitration in 1300 Saxon Dr, Orlando, Florida, 32804-2126, United States, conducted in the English or Thai language under the rules of the Thai Arbitration Institute. The arbitral award shall be final and binding and may be enforced in any court of competent jurisdiction.

Nothing in this clause shall prevent either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

13. Modification of Terms

We reserve the right to modify, amend, or replace these Terms of Use at any time at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page.
